Criminal Injury Compensation Claims

The CICA was created to provide compensation for victims who have suffered injuries as a direct result of a violent crime. 'Criminal injury' is the term used to describe physical or psychological harm that has been sustained by an individual as a consequence of this. A criminal injury compensation claim might be made if the person has been the victim of a criminal offence such as:

  • Sexual abuse as an adult or a child
  • Serious physical assault
  • Stabbing incidents that have caused serious harm and/or scarring
  • Assault, abuse or other violent crime that has resulted in a brain injury
  • A violent crime that resulted in the death of a loved one

Requirements for Making a Criminal Injuries Compensation Claim

To be able to make a claim the incident that caused your injuries must have occurred in England, Wales or Scotland and be severe enough to qualify for the minimum tariff award of £1,000. If the injuries that you suffered can be resolved within a relatively short period, they will probably be unlikely to qualify for the minimum tariff award. The scheme is limited in nature, for example, injuries such as bruising or black eyes, which clear up within a few weeks are unlikely to qualify for an award.

There are strict time limits for making a claim to the CICA. This must be done within two years, or by your 20th birthday if you were a child when the incident took place. Generally, the time limit for making a CICA application is strictly applied. Discretion to extend is rarely exercised and may well need to be negotiated with the CICA.

The incident must be reported to the police within 48 hours of it taking place, or as soon as is practicable thereafter. You must also obtain a crime reference number from the police.

Criminal convictions (other than spent motoring offences) could reduce or eliminate your entitlement to CICA compensation depending on how long ago the conviction was and what the conviction was for. You must also have been the victim of an unprovoked attack, so threats on your part to the assailant or altercations that took place beforehand could reduce or eliminate the award.

To make a claim to the CICA, you must cooperate fully with the police at all times in assisting them to bring the assailant to justice.
